By accessing or using Influmint ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

2. Description of Service

Influmint provides Instagram automation tools including but not limited to:

  • Automated direct message (DM) responses
  • Comment-triggered automation workflows
  • AI-powered growth coaching and analytics
  • Link in Bio page creation and management
  • Engagement analytics and reporting

The Service is designed to work within Instagram's official API guidelines and platform policies. We do not guarantee any specific results, follower growth, or engagement metrics.

3. Account Registration and Eligibility

A. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

B. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

C. Accurate Information

You agree to provide accurate, current, and complete information during registration and to keep this information updated. We reserve the right to suspend or terminate your account if any information provided is inaccurate, incomplete, or misleading.

4. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Spam, harass, or send unsolicited messages to Instagram users
  • Violate Instagram's Terms of Service, Community Guidelines, or Platform Policy
  • Attempt to gain unauthorized access to other accounts or systems
  • Distribute malware, viruses, or any other malicious code
  • Engage in any activity that could disable, overburden, or impair the Service
  • Use the Service for any illegal, fraudulent, or deceptive purposes
  • Scrape, data mine, or collect user data beyond what is necessary for automation
  • Sell, resell, or exploit the Service for commercial purposes without our prior written consent

5. Instagram Platform Compliance

Our Service operates through official Instagram and Facebook APIs. By using Influmint, you acknowledge and agree:

  • You are solely responsible for ensuring your use of the Service complies with Instagram's policies
  • Influmint is not affiliated with, endorsed by, or sponsored by Meta (Facebook/Instagram)
  • Instagram may change their API or policies at any time, which may affect Service functionality
  • You grant us permission to access and interact with your Instagram account as necessary to provide the Service
  • We are not responsible for any actions taken by Instagram against your account, including suspension or termination

6. Subscription and Billing

A. Free Tier

We offer a free tier with limited features. Free tier usage is subject to these Terms and may be modified or discontinued at any time.

B. Paid Subscriptions

Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated in these Terms or required by applicable law.

C. Automatic Renewal

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings or by contacting support.

D. Price Changes

We reserve the right to modify subscription prices. Any price changes will be communicated in advance and will apply to the next billing cycle.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Influmint and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you create or upload through the Service. By using the Service, you grant us a non-exclusive, royalty-free license to use, display, and process your content as necessary to provide the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INFLUMINT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Loss of Instagram followers or engagement
  • Account suspension or termination by Instagram
  • Service interruptions or downtime
  • Any unauthorized access to or use of our servers

Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee any specific results from using the Service.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms
  • Violation of Instagram's policies
  • Fraudulent, abusive, or illegal activity
  • Non-payment of subscription fees
  • Extended period of inactivity

Upon termination, your right to use the Service will immediately cease. You may request deletion of your data in accordance with our Privacy Policy.

11. Indemnification

You agree to indemnify, defend, and hold harmless Influmint and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you create or transmit through the Service

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Influmint operates, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
